Court told Tweed cop had sex on duty and gave woman gun

A POLICE officer who allegedly had sex at a police station while on duty had his case heard at Tweed Heads Court on three misconduct charges this morning.

Kingscliff Senior Sergeant Mark Anthony Garner, 48, did not appear and was represented by a solicitor Russell Baxter. 

No plea was entered at the court to the charges of misconduct in a public office, aid and abet possess unauthorised pistol and allow unauthorised person to possess pistol charges.

Court documents stated police will allege on September 16, 2011 between 2am and 4am that Garner did "misconduct himself in a public office to wit by having sexual intercourse with a female at a police station whilst on duty."

He is also alleged to have aided and abetted the possession of a prohibited pistol, which was a NSW police-issued Glock pistol, into the possession of a person not authorised or licensed to have it.

Police will further allege Garner did not take all reasonable precautions to ensure that a prohibited pistol did not come into the possession of a person who wasn't authorised.

Sen Sgt Garner was charged in November after an internal investigation took place.

The court was adjourned until March 19 at Lismore Local Court.

A NSW Police media spokeswoman was unable to confirm if the officer is suspended with or without pay.

Today was the first time the case has gone before the court.
