I want to compete, Jordan Mercer tells court

LAWYERS for Surf Life Saving Australia said they had removed "scandalous" content from court documents relating to the suspension of champion ironwoman Jordan Mercer.

Ms Mercer, who celebrated her 19th birthday on Sunday, has taken SLSA to the Supreme Court in an attempt to have the suspension lifted so she can compete in upcoming surf carnivals, including the Nutri-Grain Series which starts on December 23. It is understood Ms Mercer, the daughter of ironman icon Darren Mercer, was provisionally suspended.

She is  believed to be one of six surf life saving members, including a team official, suspended following a report about behaviour alleged to have occurred after a function at the World Life Saving Championships in Adelaide last month.

Ms Mercer competes for the Noosa Surf Club, where her father is head coach.

A lawyer for SLSA, Andrew Hoare, asked Supreme Court Justice John Byrne to return chief executive Brett Williamson's affidavit so he could make extractions.

Mr Hoare said the affidavit contained "scandalous" material.

It is believed the material related to the suspended members' alleged behaviour at the world titles.

Mr Hoare said they were "untested allegations" which were the subject of an internal review by SLSA.

That review will inform a SLSA judicial hearing to be held December 14 to 16.

Justice Byrne granted Mr Hoare leave to refile the affidavit.

Chris Tam, for Ms Mercer, argued his client was denied natural justice when she was provisionally suspended.

Mr Tam said there was nothing in the association's constitution or regulations which empowered it to suspend Ms Mercer.

Without detailing what exactly Ms Mercer is alleged to have done, Mr Hoare said she had breached a core club principle - trust.

"There was a team mate who was in a point of jeopardy and he wasn't cared for," he said.

Mr Hoare said there would be no assertion that Ms Mercer would deliberately act contrary to association duties if the suspension was lifted but highlighted the harm allegedly already done.

The case was adjounred until Friday.
