Drunk faces court after lying on top of grave

AS MOUNT Morgan's Matthew Stephen Graham lay face down on top of a grave, drunk, police arrived for the second time that week to take him away.

Yesterday Graham faced Rockhampton Magistrates Court over the incidents, where he pleaded guilty to two counts of public nuisance, one of assault police and another of obstructing police.

On August 27, about 6pm, police were called to the Mount Morgan Cemetery where they found Graham and attempted to take him to hospital.

As they moved him towards their vehicle a woman in a 4WD drove up and started yelling at police.

As they tried to calm her down, Graham also began yelling at police.

He then lunged at officers and raised a hand to hit one of them, but was put into an arm hold.

Five days earlier police were called to Black St in Mount Morgan where Graham was found yelling and causing a disturbance.

He resisted arrest as police tried to take him into custody about 8.45pm.

Solicitor Matthew Heelan said the 33-year-old was an alcoholic and on Centrelink benefits because he had been unemployed for the past few years.

Graham has a history of similar offences, and Mr Heelan said his behaviour most likely wouldn't stop without treatment for alcohol abuse.

Graham hopes to go to Townsville for treatment at a Red Cross rehabilitation centre.

Magistrate Cameron Press said past penalties, including probation and fines, obviously weren't enough of a deterrent.

He sentenced Graham to seven months' jail for the two public nuisance offences, with a parole release date of November 17.

He was also sentenced to a total of 80 hours of community service for the assault and obstructing police.

Two suspended sentences, of three months and one month, were also enacted and will be served concurrently.
