Hepatitis-C drug user charged with biting police officer
A HEPATITIS-C infected intravenous drug user alleged to have bitten the arm of an arresting police officer was unable to appear in Gladstone Magistrates Court on Tuesday because he was too affected by substances to face court.
Anthony Lee Smits was due to face four charges, including two counts of assaulting or obstructing a police officer, as well as serious assault of a police officer while armed or pretending to be armed, and serious assault of a police officer by biting.
Smits was arrested on Monday after kicking and biting an officer as he was being arrested, before advising he had Hep-C.
He was still unable to advise his legal counsel on Tuesday afternoon. Smits will reappear on Wednesday morning.
The prosecution will apply for a disease test for the injured police officer.
