HOLDEN'S Will Davison and co-driver Jonathon Webb are breathing a little easier.

But the pair still faces an anxious wait to find out whether their names will be etched in as winners of the 2016 Bathurst 1000 once and for all.

Jamie Whincup has failed in his attempt to overturn a penalty that cost him a fifth victory in the Great Race, the Supercars National Court of Appeals dismissing his claims.

However, Whincup's Red Bull Racing/Triple Eight team has a week to decide whether to take its case to the FIA International Court of Appeal.

Whincup crossed the finish line first at Mount Panarama but was relegated to 11th due to a time penalty stemming from his role in a late incident that put Volvo's Scott McLaughlin and Holden's Garth Tander out of the race.

While Red Bull Racing appealed the severity of the 15-second time penalty, it took just 50 minutes for the three-man appeal panel to dismiss it.

"Supercars welcomes the decision ... in relation to Triple Eight's appeal of a steward's decision at the Bathurst 1000,” Supercars chief executive James Warburton said.

"We look forward to this weekend's Gold Coast 600 and an exciting conclusion to the 2016 Supercars championship over the coming months.”

Red Bull Racing has not indicated yet whether it would appeal the decision.

Tander said he was focused on success on the Gold Coast after last year's podium finish there with Warren Luff.

"Ultimately you don't get in that position at Bathurst all that often, as far as inside 10 to go, battling for the lead of the race,” Tander told supercars.com.

"How do I feel? Disappointed we were caught up in other people's shenanigans in that race. Bathurst has this amazing ability of creating these unique storylines and we're just part of the most current one, that's all that is.

"Frustrated, disappointed, but ultimately nothing can be done about it now.”
