Court: Booze, rage and capsicum spray ends in cop assault
A BOOZY night at a friend's home ended with an 18-year-old being doused with capsicum spray, after swearing at police and pushing an officer in a fit of rage.
Jayden Patterson from Murwillumbah appeared before Murwillumbah Court on Wednesday, pleading guilty to assaulting a police officer.
Patterson was drinking at a Kynnumboon residence on November 10 when a fight broke out with his girlfriend about 2.05am, prompting witnesses to call police some time later.
At 4.45am police arrived at the Numinbah Rd residence and attempted to speak with Patterson and his girlfriend, entering a room to find them laying on a mattress.
Patterson leapt to his feet and began to verbally attack officers, pushing a Senior Constable and "shaping up" for a fight when they attempted to talk privately with his girlfriend, according to court documents.
A burst of capsicum spray was directed at Patterson, quickly snapping him out of his rage.
He was arrested and taken to Tweed Police Station where ambulance staff treated him for the painful effects of the spray, which includes causes immediate closing of the eyes, difficulty breathing, runny nose, and coughing
Patterson was remorseful the incident occurred, the excessive consumption of alcohol partially fuelling his actions, which were described by Magistrate Michael Dakin as "out of character".
The teenager added he was "shocked and appalled at his actions", offering a full and sincere apology to the officers involved in his arrest.
Magistrate Dakin was scathing of the incident, but said Patterson had a clean record with no history of similar incidents.
"Those who know him described his behaviour as out of character," he said.
"Alcohol played a part, but does not excuse the behaviour."
Patterson was sentenced to a two year good behaviour bond.
