Evidence in sexual assault case handed over
A MAGISTRATE will consider whether witnesses will appear in person to give evidence over the alleged sexual assault of a 75-year-old grandmother at Kingscliff.
Dayne Aaron Willott appeared in Lismore Local Court this week via video link from Junee Correctional Centre over the alleged sexual assault on January 29.
The 34-year-old from Kingscliff faces charges of aggravated sexual assault and break and enter with intent.
It is alleged Willott sexually assaulted the woman at about 8pm after she answered a knock at her door.
The woman, who was traumatised by the attack, was taken to Tweed hospital for examination before being discharged the following day.
Willott's solicitor Hugh Van Dugteren told the court he only received the brief of evidence on the case last week.
If a magistrate determines the witness or alleged victim shouldn't give oral evidence, Willott's matters will proceed based on evidence statements tendered.
He adjourned Willott's matters until June 17.
