Paedophile Robert Fardon jailed until appeal

QUEENSLAND Attorney-General Jarrod Bleijie's relentless pursuit of notorious Murwillumbah-born sex offender Robert John Fardon has paid dividends.

The Brisbane Supreme Court of Appeal ruled on Thursday Fardon should remain in jail until his appeal is heard.

The court indicated that appeal will more than likely be heard on either November 26 or 27.

Earlier this month Fardon was granted a release by the Brisbane Supreme Court, albeit under strict supervision orders.

Mr Bleijie immediately lodged an appeal, along with a stay of the release orders, to ensure Fardon remained in jail until the appeal was heard.

Under the supreme court orders, Fardon was released for two hours only to be arrested again.

Fardon's barrister Dan O'Gorman argued unsuccessfully that he posed no risk to the community given the strict nature of the supervision orders.

"The chance of him committing a serious sexual offence between now and until the appeal is heard is slight," he said.

Crown Prosecutor Peter Davis told the court earlier their submissions were based solely on Fardon's history of non-compliance to supervision orders.

He argued that nowhere in a clinical setting does Fardon say he will abide by any order imposed on him.

"He has been in jail for 35 years and is clearly institutionalised.

"We would submit the best place for Mr Fardon until the appeal is heard is where he is now."

Justice Philip Morrison said his decision did not mean the appeal would succeed.

"Given the appeal will be heard in only seven weeks the stay in custody is only brief," he said.

It is the fourth time an Attorney-General has appealed Fardon's release orders.

Mr Bleijie has hinted at rushing legislation through State Parliament next week to ensure if his appeal is unsuccessful Fardon will remain behind bars either way.
