“I will give you something to cry about” accused tells lover
POLICE allege a Tweed Heads man choked his partner before kicking her while she was down, contravening an order to stay away from her.
The 38-year-old at the centre of the allegations has pled not guilty to assault and disobeying an apprehended violence order, despite a strong case by police prosecutors.
"The case against him in this instance is strong," Magistrate Michael Dakin said while presiding over the case in Murwillumbah Court last Wednesday.
Appearing in handcuffs, the 38-year-old was brought before the court due to a warrant issued for his arrest on August 15 this year, after he failed to report to police.
Facts put forward by prosecutors say on July 4, between 10 and 10.30am, an argument developed between the 38-year-old and his de-facto partner at a Tweed Shire residence.
The man grabbed his partner's throat and slammed her against a wall, squeezing until she coughed and struggled to breathe.
Releasing her, but still in a fit of rage, the man grabbed his partner by the throat three more times, lifting her off the ground for 30 to 40 seconds in one instance.
The abuse allegedly continued, as the man pulled the woman's hair and punched a large hole in a wall near her head.
When the woman fell to the ground the man kicked her, taunting her while she cried.
"Get up, get up, he said.
"I'll give you something to cry about."
The case was adjourned until February 25 at Tweed Heads Court for what Magistrate Dakin estimated would be a two hour hearing.
The 38-year-old was released on $500 bail, subject to strict conditions.
