Jordan Mercer 'emphatically denies any wrongdoing'

CHAMPION surf life saver Jordan Mercer has rigorously denied filming an unconscious team mate being assaulted at the world surf life saving titles last month.

Ms Mercer was provisionally suspended from Surf Life Saving Australia events and training alongside five Australian team mates after disturbing allegations were raised at the world championships in Adelaide.

The 19-year-old Noosa Surf Club member took the SLSA to the Supreme Court this month in an attempt to have her suspension lifted so she could continue to earn a living and compete in surf carnivals.

Court documents, including affidavits from Ms Mercer and her lawyer, have revealed details of the explosive allegations plaguing Ms Mercer, the daughter of iconic ironman Darren Mercer.

The sworn affidavits were tendered for Ms Mercer's civil application but they do not form evidence for potential future criminal proceedings.

Included in an affidavit from Ms Mercer's lawyer Mark Lacy was an email to SLSA's lawyer Jonathan Quilty.

In the email on November 28, Mr Lacy stated Ms Mercer had advised him she "did not video the alleged incident, had not seen a video of the alleged incident" and did not have a video on her phone.

Mr Lacy stated while he heard third hand a video had surfaced the day after the incident, Ms Mercer had left early that morning.

"...I wish to emphasise that Jordan emphatically denies any wrongdoing and will vigorously defend the allegations against her," Mr Lacy stated in his email.

"At best on all available facts Jordan may be a witness to an alleged assault."

On November 26, SLSA released a media statement revealing it had suspended six members following drug use and unlawful assault allegations at the world championships.

A letter from SLSA chief executive Brett Williamson to Ms Mercer, tended to the Supreme Court, alleged Ms Mercer was present when the assault on an unconscious athlete occurred.

"Amongst the allegations are that you were present during the assault of a fellow team mate while he was unconscious," Mr Williamson wrote on November 22.

The letter also revealed SLSA had set up trauma counselling for its members following the alleged assault.

In her sworn affidavit Ms Mercer stated she had never used performance enhancing or illicit drugs.

She stated she was subject to an anti-doping test following the world titles.

"I expect I would have been notified by now had I failed that test," she swore in her affidavit.

Court documents revealed Ms Mercer's sponsors had caught wind of the allegations and her alleged involvement.

After attempting to get an interlocutory injunction on her suspension to allow her to compete, Ms Mercer and SLSA both consented to have the application dismissed in the Supreme Court.

Ms Mercer's legal team had argued the young iron woman had not been able to train for the Nutri-Grain Series, scheduled for later this month, or compete in the Oceans 38 surf carnival at Dicky Beach last weekend.

A SLSA judiciary committee, including three barristers from Queensland, NSW and South Australia, will use the next two days to investigate the allegations.

A decision on Ms Mercer and her team mates' suspensions is expected on Sunday.
