A 17-YEAR-OLD was threatened with jail time after he was caught having unprotected sex with a 12-year-old girl.
At Ipswich District Court, the teen - who cannot be named for legal reasons - pleaded guilty to three counts of indecent treatment of a child under 16 and two counts of unlawful carnal knowledge with a child under 16.
Crown prosecutor Noel Needham said the teenager had consensual sex with the girl on two separate occasions between December 15, 2014 and January 1, 2015.
During one of the sexual encounters, the teen had sex with the girl at a friend's house and was caught in the act by the friend's parents.
Prior to the offending, Mr Needham said that the teen and the 12 year old had shared a series of flirtatious messages via Facebook. He said the teen had been aware of the girl's young age at all times.
Mr Needham said under Queensland law since the girl was 12, she had reached an age where she could consent.
"She still is able to consent, even though the carnal knowledge is unlawful, it's still considered consensual," Mr Needham said.
"It's under the age of 12 years that is deemed not capable of giving consent."
Judge Greg Koppenol noted that the teen had no prior criminal record.
Judge Koppenol told the teen the offences he was charged with often resulted in jail time.
"There may not have been a big age difference but the fact of the matter is that this girl was only 12," he said.
Judge Koppenol noted the teen had entered an early plea and showed remorse.
The teen was sentenced to two years probation.
No convictions were recorded.
