THE French media executive kicked out of Clive Palmer's Coolum resort has decided not to pursue legal action.

But Didier Guerin has strongly refuted Mr Palmer's suggestion in media reports that the resort guest was asked to leave because he was "intoxicated".

In an email to the Daily, Mr Guerin said this was not true. "Only one bottle of wine was delivered to the table - not bottles - and my wife and I did not even finish it," he said.

"I never get drunk and I would challenge anyone to say he or she saw me intoxicated in the last 40 years."

The controversy has made headline news across the nation. It arose after Mr Guerin ordered a $40 "blue steak" which arrived overcooked to his standards after a 30-minute wait.

It was returned to the kitchen and 30 minutes later, a steak arrived which Mr Guerin said was undercooked.

When Mr Guerin complained to the chef, Mr Palmer, who was dining at a nearby table, intervened.

He allegedly swore at Mr Guerin, a recipient of France's highest civilian award, the Chevalier Légion D'honneur (knight of the National Order of the Legion of Honour).

Mr Guerin and his wife, who were booked into the resort for five nights, were escorted off the property.

The Frenchman was considering legal action but yesterday he said he would not be pursuing this route.

"This incident is so embarrassing that it does not deserve spending large legal fees and time in court," he said. "I need to concentrate on my business and move on."

The incident, however, has not completely tainted his views of Coolum and the Sunshine Coast.

He has been visiting the former Hyatt-managed resort since the 1990s.

"Regarding my return to Coolum, nothing is impossible ... but it might take some time," he said.
